Fire Safety (England) Regulations 2022
The Fire Safety (England) Regulations 2022 are a set of additional legal duties introduced under the Regulatory Reform (Fire Safety) Order 2005. They apply in England only and came into force on 23 January 2023. Their purpose is to strengthen fire safety management in certain residential buildings, particularly where residents rely on common parts, fire doors, building information and evacuation arrangements to stay safe.
These regulations were brought in to implement most of the Grenfell Tower Inquiry Phase 1 recommendations that required changes to the law. In simple terms, they place more specific duties on the people responsible for fire safety in multi-occupied residential buildings, with extra requirements for high-rise residential buildings.
A More Detailed Set of Duties for Residential Building Safety
The regulations sit alongside the Fire Safety Act 2021, which clarified that the Fire Safety Order applies to a building’s structure, external walls, and flat entrance doors where relevant. The 2022 regulations then added more detailed duties about the information, inspections and physical precautions that responsible persons must manage in residential buildings.
That matters because fire safety in residential buildings is not just about alarms or extinguishers. It also depends on building information being available to firefighters, residents being given clear instructions, fire doors being checked, and key safety features being properly maintained. The regulations were designed to improve practical fire safety outcomes and make compliance easier to enforce.
Key Duties Under the Fire Safety (England) Regulations 2022
The duties under these regulations fall mainly on the Responsible Person under the Fire Safety Order. In residential buildings with two or more domestic premises and common parts, responsible persons may need to provide residents with fire safety information, carry out checks on fire doors, and ensure certain building information is available. In high-rise residential buildings, further duties apply, including information about external walls, floor plans, secure information boxes and firefighting equipment.
The exact legal duties depend on the type and height of the building, so not every requirement applies to every premises. But the overall aim is the same: to make sure residents, responsible persons and fire and rescue services have the information and safeguards they need to reduce risk and respond more effectively in an emergency.
